1. What information does San Antonio Shoemakers™ collect?

SAS may collect the following categories of information:

  • Registration information you provide when you create an account with SAS or that you provide to SAS when you place an order, such as your name, address, telephone number, email address, billing address, shipping address, birthdate, username and password (“Registration Information”). Certain webpages within the Online Services require you to authorize us to collect Registration Information, including on the personal data, billing information, and wish list pages.

  • Information you provide to us when you access or use the Online Services and each time you interact with the Online Services or SAS, for example, when you update information in your online profile, communicate with us by telephone or email and order new products. Such information includes your payment information, including your credit card information and billing address.

  • We store information about the products you purchase through the Online Services, such as the product information, date of purchase, and information relating to any issue you may experience with the Website, the Online Services or our products.

  • Information you provide in public forums through the Online Services, including using our review functionality.

  • Technical information including, without limitation, usage, viewing and technical data, including your IP address or device identifier when you visit the Website or use the Online Services. If you access your account from a mobile device, that mobile device may also provide us with details of your location. Most mobile devices allow you to disable this functionality.

2. How does San Antonio Shoemakers® collect your information?

Information we automatically collect from the Website

We collect information provided to us through unique identifiers (such as IP Address or your mobile device advertising identifier) or by your browser when you view the Website or use the Online Services. This information can include information regarding your Internet service provider; the type of browser you use; your operating system; the device from which you connected to the Service; the time and date of access; the Website pages you viewed; the time you spent at our Website; the sites you visited just before and just after our Website; whether you placed any products in your shopping cart but did not purchase; and other information that does not personally identify you. SAS uses this information to understand traffic and downloads on our website, enabling us to improve the website, provide the best online experience possible and improve our product offerings and our customer service. We track this information using cookies, Google UTMs, Salesforce source codes or small text files which include an anonymous unique identifier. Cookies are a feature of web browser (Internet Explorer, Firefox, Chrome, etc.) software that allows web servers to recognize the computer used to access a site. They are small pieces of data that are stored by a user's web browser on one site to simplify subsequent interactions with that site by the same user or to use the information to streamline the user's transaction on related web pages. This makes it easier for a user to move from site to site and to complete transactions over the Internet.

Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Technical Information (as defined below) about that user and keep a record of the user’s preferences when utilizing our services. For example, SAS may use cookies to collect information regarding your visits to the Website and the products you have viewed.

SAS may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.

Do Not Track (“DNT”) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. SAS and the Online Services currently recognize browser DNT signals, however, we continue to use cookies solely to complete orders and other similar functions.

By using the Website or the Online Services, you agree to allow us to use cookies in accordance with this Privacy Policy.

Information you provide to us by using the Online Services

In addition to the information provided automatically by your browser when you visit the Website, we collect information you provide to us. This information may include, without limitation, your email address, name, phone number and payment information (including your payment or delivery address).

In order to process your order correctly and to keep you informed of any pertinent information regarding your order(s) or our company, we will collect the following information, depending on the situation:

  • Name, date of birth, gender, shoe size, shoe width and preferred footwear style for transactional purposes;

  • Name, email address, shipping address, order history, and wish list for future purchases; and

  • Name, address information, phone number, and payment information such as credit or debit card number, expiration date, and security codes necessary for processing orders/returns only, provided that such payment information is collected, used and stored by SAS’s third party payment processors, and not by SAS.

The above information is collected or can be collected when a purchase is made, when you sign up for our online newsletter or when you sign up for an online SAS profile. If you choose to provide us with feedback through our Website, we will also collect such feedback information so that we can respond to you.

At some point during your transaction or when you visit the Website, you have the option of signing up for a profile with SAS. We will use the information you provide to us through your profile to simplify your future checkout process, to keep you apprised of past and current orders, update you with news and promotions, and to gain insight regarding your style preferences in order to better serve you. By providing us with your Registration Information through the Website or the Online Services, you are authorizing us to collect, store and use such Registration Information, including without limitation your email address, in accordance with this Privacy Policy.

3. How does San Antonio Shoemakers® use your information?

SAS may use your data for the following purposes:

  • To provide and improve the Online Services and to help us communicate with you, to administer your account and to process payments. For example, in addition to using your information for order processing, we may also use the provided information to communicate to you about your order (such as shipping, returns, or order status), to solicit feedback, to provide technical support or to update you about any news (e.g., company updates, promotions, sales, etc.) concerning SAS, our products and the products and services of third parties. We do this to ensure we are providing you with the best service and products available to you and, most importantly, to build a relationship with you.

  • To customize content, user experiences and advertising, monitor and analyze the Online Services usage and trends. We may share aggregated information on usage behavior (“Technical Information”) (such as order patterns or order preferences) for market research or other purposes. This aggregated information will not contain any personally identifiable information of any individual. We reserve the right to use Technical Information in our discretion and to disclose such Technical Information to our partners, advertisers and other third parties.

If you would like to opt out of receiving emails from us for marketing or promotional purposes, you may contact us, or select the “unsubscribe” link included in each of these emails. Please note that even if you choose to opt-out or unsubscribe from such emails, you will continue to receive administrative and non-promotional emails from us in order for us to continue providing the Online Services to you.

4. When does San Antonio Shoemakers® share your information?

SAS will share information about you outside of SAS in the following circumstances:

  • To third party service providers. We may contract or partner with a third party and/or individuals to facilitate our Online Services, to help fulfill orders and process returns, host the Website and the Online Services, provide the Online Services on our behalf, provide customer support, perform Website-related services (e.g., without limitation, maintenance services, database management, web analytics, improvement of the Website’s features, etc.) or to assist us in analyzing how our Website and Online Services are used. These third parties have access to your Registration Information only to perform these tasks on our behalf and are obligated not to disclose or use your Registration Information for any other purpose.

In the event we undergo a sale of some or all of the business as a result of any form of transaction, (such as a merger, acquisition by another company, sale of all or a material portion of our assets or stock, change in corporate control, insolvency or bankruptcy proceedings, etc.), your Registration Information and Technical Information may be among the assets transferred. Public Venues and Semi-Public Venues of the Services.

If you use a review function, or other public or semi-public venue of the Services, you will be identified on those venues by the username you submit.

Information you provide on public or semi-public venues, including information you share on third party social networking platforms (such as Facebook or Twitter) may also be viewable by other users of the Online Services and users of those third party platforms. We cannot be responsible for any information you choose to post on public or semipublic venues and we recommend careful consideration before you post such information.

5. How does San Antonio Shoemakers® protect your information?

Although we take reasonable steps to safeguard and prevent unauthorized access to this information, we can't be responsible for the acts of those who gain unauthorized access, and we make no warranty, express, implied or otherwise, that we will be able to prevent such access. By visiting the Website and using the Online Services, you acknowledge that you understand and agree to assume these risks.

6. How does San Antonio Shoemakers® process its secure online payments?

To provide secure credit card processing when ordering from us, orders placed on our website are processed through a payment gateway which operates under its own privacy policy. We use third party payment processors to collect and store your payment card information and to process payments in connection with the Online Services. If you choose to purchase any products or services from us online using a credit card, the credit card information is sent to the third party payment processor using an industry-standard method for protecting data as it travels over the Internet. Any information that you provide to our payment processors is governed by each processor’s separate privacy policy instead of this Privacy Policy. 7. What control do you have over your Registration Information?

Although we try to limit access to your information as set forth in this Privacy Policy, we also expect that you will take necessary precautions when providing any information on our Website.

We ask that you monitor all your credit and debit card transactions concerning SAS and immediately notify us of any suspicious transactions or any unexpected correspondence (whether through email or traditional mail).

As part of the Online Services, we may provide links to and allow you to connect to other websites or applications to allow you the opportunity to share information about SAS, our images and any news from our Website. We do not control such other sites and are not responsible for the privacy practices employed by such third party websites, applications or the information or content they contain. SAS expressly disclaims any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of information by third parties.

This Privacy Policy does not apply to your use of any third party website accessed by selecting a link on the Website or via the Online Services. Please keep in mind that when you post information on a third-party site or platform such as our third party payment processors, the information you provide may be separately collected by the third-party site or platform. The information we collect is covered by this Privacy Policy and the information the third-party site or platform collects is subject to the third-party site or platform’s privacy practices. Privacy choices you make on the third party site or platform will not apply to our use of the information we collect directly through our Online Services.

Such third party websites have their own policies regarding privacy; it is in your best interest to review them before sharing.

9. Children

We do not knowingly collect, use or solicit information from a child aged 13 or younger. If you are a parent or guardian of a child aged 13 or younger or if you otherwise believe a child aged 13 or younger has given us information, contact us, and we will make take steps to delete the information as soon as possible.

10. Users Outside the United States

This Privacy Policy is intended to cover collection of information from residents of the United States only. SAS is a corporation organized under the laws of Texas. The Website and the servers upon which the Website is hosted are located in Canada or in the United States. Those who access or use the Online Services or the Website from other jurisdictions do so at their own choice and risk and are solely responsible for compliance with local law. Please note that the information you submit using the Online Services may be transferred to, and collected, processed, stored and used in, Canada or the United States, so that we can provide the Online Services and the Website to you as set forth in this Privacy Policy and the Terms of Use. Please note that the level of legal protection provided in the United States or other non-European countries in which you may access the Website or use the Online Services may not be as stringent as that under European Union privacy standards or the privacy laws of some other countries, possibly including your home jurisdiction. You acknowledge and agree that we may collect, transfer, process, store and use your information outside your home jurisdiction, and that we may transfer to, and collect, process, store and use your information in, Canada or in the United States.

11. Changes to Our Privacy Policy

SAS reserves the right change this Privacy Policy at any time and apply all changes as permitted by law. When we do update this Privacy Policy, we will also revise the “Last Revised” date at the top of the Privacy Policy. If we make changes to the Privacy Policy that, in our discretion, we consider significant, we will take steps, such as notifying you of or obtaining your consent for the updated Privacy Policy in accordance with applicable law. Non-material changes or clarifications will take effect immediately. Please review this Privacy Policy periodically to stay informed about our privacy practices.
